    Did you know that your boss may be driving around in a Lexus purchased with overtime pay that should have been given to you? That’s right, your employer or former employer may owe you enough overtime money to take a vacation, buy a car, or put a down payment on a home, and you don’t even know it! As Lawyers’ Weekly USA recently reported (1/7/02), "An overtime claim is a sleeping giant that lurks in a lot of cases and is often passed by. Experts seem to agree that violations are extremely common in nearly all industries." Did you know there is an estimated $39 billion owed to employees paid on a salary who really should be paid overtime under often overlooked overtime laws? That’s right- $39 BILLION! Pharmacists at Eckerds found out about and asserted their overtime rights and recently won an $8 million settlement.   • Comp Time

    With very few exceptions, it is illegal in the private sector to give “comp time” to an employee in order to avoid paying them overtime. In other words, it is illegal to “carry hours” of an employee from one week to the next to avoid having to give overtime pay. And don’t be fooled because you are a secretary at a law firm who is forced to take comp time and can not believe that lawyers would violate the overtime laws. A great number of overtime laws are not even known by many lawyers!
  • Babysitters, Nannies, and Domestic Help

    Nannies and babysitters who regularly work over 20 hours per week in someone’s home taking care of their child or children are entitled to overtime pay when they work more than 40 hours in a week. It does not matter if you have been put on a “salary” or not. That “salary” must be reduced to an hourly rate and you are due time and a half for all hours over 40 that you work in a given week.
